Links Sort by: Date | Hits | Alphabetical2nd Amendment extension likely: McDonald v. Chicago March 3, 2010 10:25:59The Supreme Court on Tuesday seemed poised to require state and local governments to obey the Second Amendment guarantee of a personal right to a gun, but with perhaps considerable authority to regulate that right. The dominant sentiment on the Court was to extend the Amendment beyond the federal level, based on the 14th Amendments guarantee of "due process," since doing so through another part of the 14th Amendment would raise too many questions about what other rights might emerge. - [Read more] |

A bulls-eye for the Supreme Court June 29, 2010 10:14:06In the "living Constitution" era, the Supreme Court rediscovers original intent and rightly rules that the right to bear arms applies to all Americans just as the rest of the Bill of Rights does.
Its hard to conceive how the justices could have decided otherwise. A few thoughts on the McDonald argument March 3, 2010 10:24:27Based on a quick read of the oral argument transcript, a few things stood out:
1. The Privileges or Immunities arguments never really got off the ground. None of the Justices seemed in favor of that approach, at least based on the questions. (Justice Thomas, as is his custom, asked no questions.) Only about 10-12 minutes of the questioning even concerned the P or I route, and the questioning seemed mostly focused on trying to understand the nature of the claim. For my VC co bloggers and... - [Read more] |
A new move to ban hunter harassment April 13, 2010 09:07:04For Robert Millage, killing the first wolf in Idahos inaugural hunt was a dubious honor. In May 2009, the gray wolf was taken off the list of endangered species for the Northern Rocky Mountain region, and debates between hunting advocates and wolf sympathizers raged in the months leading up to the start of hunting on the first of September.
Shortly after the sun rose that morning, Millage, a real estate agent from northern Idaho, shot the historic wolf. Within a few hours, he started getting... - [Read more] |
Access as guaranteed by the Second Amendment May 3, 2010 09:45:44Nebraskans have long held our rights close to our hearts especially our Second Amendment right to bear arms. The Second Amendment guarantees an individual the right to keep and bear arms; however, for too long this right has been denied to some Americans simply because of where they live.
Law abiding citizens who live in Chicago and Washington, D.C., have just as much right to protect themselves and their families as do Nebraskans, yet these two cities have such restrictive gun access... - [Read more] |
